The Building Inspection Department is responsible for administering the residential zoning ordinances and enforcing the Village's construction standards, code for new buildings and remodeling of existing buildings.
Specific duties of the building inspector include:
Reviews plans and surveys and issues building, plumbing, electrical, HVAC, signs, swimming pools, and occupancy permits
Conducts inspections and investigations
Issues electrical licenses
Reviews complaints
Enforces the Zoning Ordinance and building, plumbing and electrical codes
Oversees and schedules work for the Assistant Inspector
Attends Plan Commission meetings as an advisor

When do I need a Building Permit?
Building permits are required to construct any new building, add to an existing building or for alterations involving structural changes.
Permits are required for:
Roofing Windows Siding/Trim Sheds
Decks Fences Pools Basement remodels
Additions Electrical Plumbing HVAC (furnaces/ central air)
Driveway flairs and approaches
While it is common for contractors to obtain permits, it is the responsibility of the homeowner to make sure the required permits are obtained. If you are unsure whether you need a permit for your project, call the Building Department at 246-5212.
Starting a project before the required permits are issued can result in double fees and/or fines. Also, some subdivisions have their own requirements, so check with your "Homeowners Association" to determine if your project is allowed.

Lawns, Driveways and Bonds
For new construction, lawns must be installed within one growing season, i.e. if you move in April, the lawn needs to be established by September of that same year; if you move in October, the lawn is to be established by May of the following year. Failure to complete lawns and driveways within the specified time limits can result in forfeiture of bonds and/or the issuance of daily citations and fines.
It is also important that you maintain your erosion control until your lawn is established. Failure to do so can result in clean-up costs, damage to our streams, and can impact your new neighbors who have to deal with rocks and soil on the roads.
Landscape and street cleaning bonds are refunded when the driveway is installed and the lawn is established and has been mowed at least twice. Call the Building Inspection Department to schedule an inspection when your driveway and lawn are completed.

Swimming Pools
Permits Not Required:
Kiddies/Wading Pools - Maximum 24" water depth; no filters; water changed daily.
Relaxation/Floating Pools - Maximum 24" to 30" water depth and has a filter. All electrical connections to the pool shall be properly grounded and must have a FGCI outlet. No extension cords. Must be covered when not in use.
Permits Required:
Swimming Pool - Maximum water depth greater than 30" and has a filter. All electrical connections to the pool shall be properly grounded and must have a GFCI outlet. No extension cords. Must have a 4' fence or pool wall height of 48" and with a locking ladder. Requires building and electrical permits.

NOTE: Some subdivisions have their own regulations regarding pools. Check with your homeowners association.

Hiring a Contractor
The Village of Sussex advises property owners to hire contractors that are insured and bonded. Contractors that are bonded, insured and registered with the State of Wisconsin do receive a license; ask for a copy of their State Certification. Certification numbers can be tracked on the Department of Commerce Safety and Buildings Division web site.; www.commerce.state.wi.us/SB/SB-CredentialStatusCheck.html.
Starting January 1, 2008, a State Certified Contractor is also required to have on staff an individual who holds the new Dwelling Contractor Qualifier Certification in order to take out a building or erosion control permit for one - or - two-family dwellings. To receive the Contractor Qualifier Certification, an individual must complete an approved 12-hour course in dwelling construction.
If a homeowner hires a contractor that is not state certified, or the homeowner does the work themselves, he or she may be held liable for bodily injury or property damage to others arising out of the work performed under the building permit, and may not be able to collect from the contractor for damages.
As of July 1, 2009, commercial building contractor businesses that operate in the State of Wisconsin need to be registered with the State Department of Commerce, Safety and Buildings Division.
The Building Contractor Registration (BCR) is for businesses whose work is regulated under any of the Commerce codes affecting commercial buildings, places of employment, one- and two-family dwellings, and public swimming pools.
People already holding dwelling contractor certifications do not need the BCR to obtain one- and two-family building permits. |
